Please read this refund policy carefully before making any payment to Parth Media. This policy clearly states our position on refunds for all services.

NO REFUND POLICY

All advance payments, pre-paid credits, and service fees are strictly non-refundable.

Once paid, no amount will be refunded under any circumstances.

By making a payment to Parth Media, you explicitly agree to this no-refund policy.

1. General Refund Policy

At Parth Media, we maintain a strict NO REFUND policy for all services rendered. This includes but is not limited to:

  • Advance payments for any service
  • Pre-paid SMS/WhatsApp/IVR credits
  • Setup fees and integration charges
  • Monthly/annual subscription fees
  • API access fees
  • Custom development charges
  • DLT registration assistance fees
  • Any other fees collected for our services

Important:

Once a payment is made, it cannot be cancelled, reversed, or refunded, regardless of whether the services have been fully utilized or not. This includes situations where you decide to discontinue using our services before the end of the billing cycle.

2. Third-Party Nature of Services

Our services involve integration with various third-party platforms and telecom operators. This is why refunds are not possible:

When you make a payment to Parth Media, a significant portion is immediately paid onward to:

  • Telecom Operators: For SMS delivery, IVR minutes, and connectivity
  • Meta (WhatsApp): For WhatsApp Business API conversation charges
  • Google (RCS): For RCS messaging services
  • DLT Platforms: For registration and template approval fees
  • Infrastructure Providers: For cloud servers, APIs, and network resources

These third-party costs are incurred immediately upon your payment and are non-refundable by the third parties themselves. Therefore, we cannot refund amounts already paid to these providers on your behalf.

Examples of third-party costs that are non-refundable:

  • Telecom operator charges: When you purchase SMS credits, we pay telecom operators for delivery infrastructure. These charges are non-refundable by operators.
  • WhatsApp conversation fees: Meta charges for WhatsApp conversations as soon as they are initiated. These fees cannot be reversed.
  • DLT registration fees: Government and platform fees for DLT registration are non-refundable once applied.
  • Virtual number rental: Numbers are leased from telecom providers on a monthly basis and cannot be returned for refund.

3. No Exceptions

We do not make exceptions to this no-refund policy, including but not limited to:

  • Dissatisfaction with services: If you are unsatisfied with our services, we encourage you to contact us to resolve issues, but refunds will not be issued.
  • Change of mind: Deciding you no longer need the services after payment does not entitle you to a refund.
  • Technical issues: While we strive for 99.9% uptime, temporary technical issues do not qualify for refunds. We will always work to resolve any technical problems promptly.
  • Business closure: Closing your business or discontinuing operations does not entitle you to a refund of unused credits.
  • Accidental purchase: Even if you made a payment by mistake, we cannot process refunds due to the immediate third-party costs incurred.

Legal Precedent:

Indian courts have consistently upheld that service providers are not required to refund amounts already disbursed to third-party vendors. By accepting these terms, you waive any right to claim refunds on this basis.

4. Advance Payments and Prepaid Credits

Many of our services require advance payment or purchase of prepaid credits. These include:

  • SMS packs: Pre-purchased SMS credits valid for a specified period.
  • WhatsApp conversation packs: Pre-paid bundles of WhatsApp conversations.
  • IVR minute packs: Pre-paid minutes for IVR calls.
  • Annual maintenance contracts: Pre-paid annual service fees.

Policy on unused credits: Unused credits expire at the end of their validity period and are not refundable. No cash equivalent will be provided for unused credits under any circumstances.

Early termination: If you choose to terminate services before using all prepaid credits, those credits are forfeited and no refund will be issued.

5. Cancellation Policy

While we do not offer refunds, you may cancel your services at any time. However:

  • Cancellation will only stop future charges (if applicable).
  • No pro-rated refunds will be issued for the current billing period.
  • Prepaid credits remaining at the time of cancellation are forfeited.
  • Setup fees, integration charges, and other one-time fees are non-refundable even if you cancel immediately after payment.

6. Dispute Resolution

If you have concerns about charges on your account, please contact us immediately. We will investigate and respond promptly. However, please understand that investigation does not imply or guarantee a refund.

In the event of a billing error on our part (e.g., duplicate charge), we will correct the error by crediting your account or adjusting future invoices. Cash refunds will not be issued even in such cases.

Chargebacks: If you initiate a chargeback or dispute with your bank or payment provider without first contacting us, your account may be immediately suspended, and you will be responsible for all fees incurred in connection with the dispute. You also agree that we may pursue legal action to recover any amounts wrongfully charged back.

7. Acknowledgment

By using our services and making payments to Parth Media, you acknowledge that:

  • You have read, understood, and agree to this no-refund policy.
  • You understand that our services involve third-party costs that are incurred immediately upon your payment.
  • You agree that all payments are final and non-refundable.
  • You waive any right to claim refunds through consumer courts, civil courts, or any other dispute resolution forums on the basis of this policy.

This refund policy is governed by the laws of India. Any disputes arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts in Varanasi, Uttar Pradesh.
